Terms and conditions of sale

The terms apply between the customer and Hallingdal Badestamp AS. Below you will find the conditions that apply to the purchase of goods and services from hallingdal-badestamp.no by consumers. These conditions, together with your order as confirmed by an order confirmation, form the basis of the contract of sale. Purchases are governed by Norwegian law, including the Consumer Purchases Act, the Right of Withdrawal Act, the Marketing Control Act, the Personal Data Act, the E-commerce Act and the Credit Purchases Act.

1. The parties

2. The purchase process in the online shop

  • When you place an order with us, the order is binding as soon as it has been registered with us. We are bound by your order as long as it does not depart from our offer in the online shop, our marketing or otherwise. You can withdraw from the purchase under the Right of Withdrawal Act, see points 9 and 11.
  • We send an order confirmation when we receive your order. Read it through and check that the order confirmation matches your order. If there is a discrepancy between the order and the order confirmation, we regard that as a new offer from us, which you can accept or reject. You have the right to hold us to the original order if it corresponds to our offer.

3. Formation of the contract

  • The contract is binding on both parties when the buyer has sent their order to the seller.
  • The contract is nevertheless not binding if there has been a typing or keying error in the seller’s offer in the ordering system in the online shop or in the buyer’s order, and the other party realised or ought to have realised that there was such an error.

4. Information in the online shop

  • We work to give correct information about our products. We reserve the right to typing or printing errors, which may mean that we cannot deliver in accordance with the information in the online shop or in our marketing.
  • We reserve the right to cancel your order or parts of it if the products are not available. You will be told about this and about alternative products we can offer. You can choose to accept the new offer or to cancel the order.

5. Prices

  • All prices include VAT. The total cost of the purchase, including all charges such as postage, freight, packaging and installation, is stated before you place your order.

6. Payment

  • Payment: invoice or bank transfer. For made-to-order items we require advance payment of 50 %. The rest is paid before delivery or collection. If payment is not made, the claim will, after prior notice, be sent to debt collection.
  • You can also pay with Klarna in the online shop. Klarna’s terms then apply to the payment.

7. Delivery and delay

  • The products are delivered in the manner, at the place and at the time agreed. We bear the risk for the products until they have been taken over by you, that is, when you have received them.
  • In the event of a delay we will tell you as soon as we know about it, and inform you of when delivery can be expected.
  • Depending on the type of product and the length of the delay, you can choose to withhold payment, demand delivery, claim damages or cancel the purchase.
  • Freight price: free within 60 km of Flå. In other areas we ship with Apollo; the freight is calculated by weight and volume, and you get the price before you pay.
  • Delivery: made-to-order items are produced and delivered within approx. 4–6 weeks.
  • Collection: you can collect the goods yourself at the address Austsidevegen 901, 3539 Flå.

8. Inspection of products

  • When you receive the products, you should check as soon as possible that the delivery matches the order confirmation, whether the products have been damaged in transit, or whether there are other faults or defects. Transport damage must be reported immediately to the carrier.

9. Complaints — the Consumer Purchases Act

  • If you discover a fault or defect in the product, you must, within a reasonable time after the fault was discovered or ought to have been discovered, notify us that you wish to invoke the defect. The deadline for complaints is two years after you took over the item. For items intended to last significantly longer under normal use, the deadline for complaints is five years. A complaint must be made within these deadlines, otherwise you lose the right to assert the defect. A defect that appears within 2 months of the takeover is presumed to have been present at the passing of risk.
  • Faults and defects should be reported to us orally or in writing. For reasons of evidence we recommend that the complaint is sent in writing.
  • You will receive a confirmation by email that we have received the complaint. The confirmation also gives information about any special terms or handling for return shipments.
  • If there is a defect and you have complained within the deadlines, you can assert the following claims:
    • withhold the purchase price
    • choose between repair or replacement, subject to certain conditions
    • demand cancellation of the purchase if the defect is not insignificant
    • claim damages
  • If repair or replacement means that you cannot use the item for more than a week, you are entitled, subject to certain conditions, to have a replacement item made available to you at our expense. As a general rule we cannot make more than two attempts at repair or replacement for the same defect.
  • If there is no defect, we can only charge for the investigations that were necessary to determine whether there was a defect, as well as for repair of the item, if you have been told that you must cover such costs.
  • If you take steps on your own initiative to remedy a defect beyond what has been agreed with us, we do not cover those costs.

10. Guarantee

  • 2 years.

11. Right of withdrawal

  • For standard products you have the right to withdraw from the purchase under the Right of Withdrawal Act. The right of withdrawal requires that you notify us no later than 14 days after receipt of the delivery. If you have not received a withdrawal form with the order confirmation or on delivery, the deadline is extended to three months. For the right of withdrawal to be exercised, the product must be returned to us in essentially the same quantity and condition. All products must be returned within a reasonable time. Any return shipment is paid for by you, and you bear the risk for the transport back to us. We are obliged to refund what you have paid, including the postage for the shipment to you, within fourteen days after we have received the product from you. The product must be sent back in its original packaging.
  • The right of withdrawal does not apply to goods customised to your requirements.

12. Personal data

  • We take care to handle your personal data in a secure way. When you buy from us, we store information such as name, address and email address, which is necessary in order to deliver the goods to you and contact you about your order. The information must also be stored for accounting, tax handling and any guarantee or returns processing. Read more in the privacy policy.
  • We do not sell personal data to third parties, and we do not exchange or pass this information on.

13. Prices and delivery

  • All our prices are stated including VAT, but excluding freight, unless otherwise stated. Prices may change as a result of price changes from our suppliers. We reserve the right to refuse delivery of goods because of price fluctuations, the stock situation, competitive conditions or other reasons. All stated delivery times are indicative. “Delivery time” means the point at which the goods arrive at our warehouse. Time for picking, packing and any production comes in addition, before the goods are handed over to the carrier.
  • Delivery within 60 km of Flå is free. In other areas we ship with Apollo, and the freight price is calculated by weight and volume.

14. Returns and exchanges (does not apply to made-to-order or customised goods)

  • If you want to return an item, you must tell us no later than 14 days after you received the item. It is possible to return goods and get your money back if the item is damaged. The seller pays the freight.
  • When you receive the order, it is important to check it for damage.
  • If the item is damaged or broken, you can contact us at post@hallingdal-badestamp.no for further instructions.

15. The customer’s obligations

  • Whoever is registered as a customer with us is responsible for payment for the services that we or our partners provide under these terms. The responsibility also covers other people’s use of the customer’s access, including use by unauthorised persons, unless it can be shown that such use has taken place through negligence on our part.

16. Liability for incorrect use

  • We do not accept liability for faults, defects or problems that arise from incorrect use of the products.

17. Changes to the terms

  • We reserve the right to change these terms, including as a result of changes in legislation.

18. Force majeure

  • If we are prevented from delivering, or it becomes unreasonably burdensome for us to fulfil the delivery obligation because of industrial action or other circumstances outside our control — such as fire, war, mobilisation, unforeseen military call-ups of a similar scope, requisition, seizure, currency restrictions, insurrection, shortage of means of transport, general shortage of goods, restrictions on energy supply, and faults or delays in deliveries from sub-suppliers or manufacturers because of such circumstances — we are released from all liability other than in respect of complaints, and we credit the purchase price for the defective item.

19. Dispute resolution

  • Complaints are to be addressed to the seller within a reasonable time. The parties shall try to resolve any disputes amicably. If that does not succeed, the buyer can contact Forbrukerrådet, the Norwegian Consumer Council, for mediation. Forbrukerrådet can be reached on telephone 23 400 500 or at forbrukerradet.no.
  • The European Commission’s complaints portal can also be used if you want to submit a complaint. This is particularly relevant if you are a consumer resident in another EU country. The complaint is submitted at ec.europa.eu/odr.
